The Trial of Diddy

It’s Not About Diddy, It’s About These Women

1137.685

There's so much more coming up, but for now, let's pause for a break.

The Trial of Diddy

It’s Not About Diddy, It’s About These Women

115.452

And I'm Marjorie Hernandez, DailyMail.com's West Coast news editor.

The Trial of Diddy

It’s Not About Diddy, It’s About These Women

1214.113

Welcome back to The Trial of Diddy. We're still here with Nancy Grace.

The Trial of Diddy

It’s Not About Diddy, It’s About These Women

139.49

We certainly could, Kayla. But for this week, Diddy's legal team actually added a new member, Atlanta-based attorney Brian Steele, who has previously represented Young Thug. Steele submitted paperwork with the United States District Court in the Southern District of New York on Tuesday, indicating his intent to appear as counsel for Diddy when the trial properly kicks off in just 26 days.

The Trial of Diddy

It’s Not About Diddy, It’s About These Women

1607.174

So for now, that's it. Thanks again to our guests, the wonderful Nancy Grace. And as we prepare for Diddy's own trial in May, what other trials would you like for us to cover? Let us know by email, thetrialatdailymail.com, or you can WhatsApp us on plus44-7796-657-512 and start your message with trial.

The Trial of Diddy

It’s Not About Diddy, It’s About These Women

163.897

He's actually a very interesting attorney. Brian Steele is a seasoned criminal defense attorney, but he's, again, based in Atlanta, Georgia, which is why he actually filed a request to be able to practice in New York to join Diddy's team.

The Trial of Diddy

It’s Not About Diddy, It’s About These Women

178.382

And as we mentioned earlier, he's best known for representing Young Thug in his own racketeering case, which actually was the longest in Georgia's history, I believe. What's interesting, again, about him, he's really known as being very aggressive and tough in court, and he really stands his ground. At least that's what a lot of the other attorneys who I spoke to have said.

The Trial of Diddy

It’s Not About Diddy, It’s About These Women

201.373

He was even actually held in contempt in court during that trial because he refused to disclose how he learned about a private meeting between a judge, prosecutors, and a key witness in that case. So that actually was later reverted, that contempt ruling. against Steele, which was ruled by the Georgia Supreme Court. And so he was able to go on with the case.

The Trial of Diddy

It’s Not About Diddy, It’s About These Women

226.527

But TMZ actually also reported that Diddy's legal team was looking to add a black attorney after Anthony Rico left the case. So it was kind of a surprise that Brian Steele's name came up.

The Trial of Diddy

It’s Not About Diddy, It’s About These Women

25.774

At the height of his career, Sean Diddy Combs had it all. It seemed like everything Diddy touched turned to gold. Now the once untouchable hip-hop mogul is fighting for his life as he faces multiple federal charges in New York, including sex trafficking and allegedly running a criminal enterprise.

The Trial of Diddy

It’s Not About Diddy, It’s About These Women

277.583

And that hearing you mentioned there also featured Combs' lawyers suggesting that they may require a two-week adjournment for his trial if they don't receive what they described as critical evidence from prosecutors. One of Combs' attorneys, Tenny Garagos, said the defense hasn't received some 200,000 emails between Diddy and one of the alleged victims. Now, here's a question for you, Kayla.

The Trial of Diddy

It’s Not About Diddy, It’s About These Women

310.951

Want to take a guess?

The Trial of Diddy

It’s Not About Diddy, It’s About These Women

324.618

So using my calculator came up with 36 and that means 18 emails a day each every single day for 15 years.

The Trial of Diddy

It’s Not About Diddy, It’s About These Women

333.886

That's incredible. So that's something to ponder there. So anyway, Assistant U.S. Attorney Chrissy Slavik said prosecutors opposed any delay and went on to accuse Combs's lawyers of using, quote, gamesmanship to delay the trial. Judge Subramanian, a man with a good turn of phrase, told the defense, saying, quote, we are on a freight train speeding towards trial.

The Trial of Diddy

It’s Not About Diddy, It’s About These Women

354.608

If you want an adjournment, you need to make that application within the next 48 hours.

Welcome to the Trial of Diddy.

The Trial of Diddy

The Prior Bad Acts Question

114.808

And I'm Marjorie Hernandez, DailyMail.com's West Coast news editor.

The Trial of Diddy

The Prior Bad Acts Question

171.144

And of course, there's more. On the same day, April 4th, Diddy's legal team filed a motion to exclude, quote, prior bad acts evidence.

The Trial of Diddy

The Prior Bad Acts Question

181.828

What was in your reporting? Yeah, we obtained some court documents from both sides and essentially prior bad acts, that is actually a legal term that refers to evidence of past actions that's not actually directly related to the current charges that defendant has committed.

The Trial of Diddy

The Prior Bad Acts Question

201.195

So, again, in this case, the prosecution wants to introduce evidence, which is here more than likely other witnesses who can testify about their own experiences of abuse or sexual assault with Diddy, which prosecutors say will show his character or what they say propensity. to commit the crimes that he has been charged with.

The Trial of Diddy

The Prior Bad Acts Question

221.891

So now these witnesses are, in addition to the four named victims who are in Diddy's criminal complaint, including Cassie, as we mentioned. Normally, prior bad acts evidence are not actually admissible, but there are exceptions, especially in cases like this, in sexual assault trials, where the evidence may be allowed to prove motive or intent.

The Trial of Diddy

The Prior Bad Acts Question

243.428

And that's what essentially both sides are arguing right now. Didi's attorneys don't want those witnesses to come forward and take the stand. And prosecutors saying, look, we need these new witnesses to come forward and to talk about a pattern of behavior that Didi has had.

The Trial of Diddy

The Prior Bad Acts Question

The Prior Bad Acts Question

323.948

Right. It'll be interesting to see whether or not they'll have another hearing just to argue in front of the judge about this. They both sides, the prosecution and the defense team have laid out their arguments. It would be up to the judge whether he actually just goes ahead again, makes the order or it will be argued in court in another hearing.

The Trial of Diddy

The Prior Bad Acts Question

344.629

So what is interesting here is defense attorneys are saying, look, if the judge will allow all of these other prior bad act witnesses, this could lead to many trials. They would argue, you know, they shouldn't be allowed to testify because it would be too prejudicial. So this could who knows how long it'll take in terms of actually getting the trial started.

The Trial of Diddy

The Prior Bad Acts Question

367.239

That could mean that it could push back the trial. I don't know. Now, the defense attorneys also argued, look, we can argue this for another trial even before we pick the jury. So right now, we're not quite sure where it will land. So anxiously waiting to see what the judge says.

The Trial of Diddy

The Prior Bad Acts Question

46.072

Music mogul and rapper Sean Diddy Combs has faced four different lawsuits in recent weeks alleging sexual assault. I'm DailyMail.com journalist Marjorie Hernandez. And over the last six months, I've been investigating this incredible story and speaking to the people in the eye of the storm.

The Trial of Diddy

The Prior Bad Acts Question

471.576

Yeah. And what, going back to now the argument over whether or not to bring forth the prior bad act witnesses, you know, this really boils down to victim testimony. It's Diddy's word against all of these alleged victims. And that's why it's so important to see whether or not there'll even be more people who could take the stand and what kind of other evidence that they have to show that

The Trial of Diddy

The Prior Bad Acts Question

496.118

his quote-unquote propensity to commit these crimes so we shall see how that shakes out and whether the judge will actually allow it there's so much more coming up but for now let's pause for a break

The Trial of Diddy

The Prior Bad Acts Question

579.079

Welcome back to The Trial of Diddy. And now as we record this on Wednesday, it's 33 days until the trial itself begins, but only 26 days until May 5th when jury selection starts. So we are getting very, very close to this incredible case beginning properly. And as we get closer, some big names are beginning to come out and speak publicly.

The Trial of Diddy

The Prior Bad Acts Question

602.557

Last Friday, Iron Man and Empire actor Terrence Howard became the first major star to speak up, alleging Diddy made a sexual advance towards him during what he described as a, quote, bizarre encounter. While appearing on the PBD podcast, 56-year-old Howard told a story about Diddy saying, quote, invited me for weeks, asking me to be his acting coach for a while.

The Trial of Diddy

The Prior Bad Acts Question

625.686

However, when they met, Howard alleged that Diddy simply sat there staring at him to the point where it began to make him feel uncomfortable.

The Trial of Diddy

The Prior Bad Acts Question

710.148

Yeah, truly, really. I was a bit shocked about the story. But as you mentioned, most people have turned their backs on Diddy. So now I think more and more people are going to feel more comfortable to come out there with their own experiences with him. And of course we are all still waiting on who the prosecutors were actually called to the stand. We don't even know who was on that witness list.

The Trial of Diddy

The Prior Bad Acts Question

735.617

Could be some celebrities there. We don't know yet.

The Trial of Diddy

The Prior Bad Acts Question

77.372

Welcome to the Trial of Diddy.

The Trial of Diddy

The Prior Bad Acts Question

772.389

Yes, I'm planning to be there as well. Don't know for the duration of the trial, but definitely the trial will be out there.

The Trial of Diddy

The Prior Bad Acts Question

823.699

Kayla, you've covered other cases before that's high profile. Can you tell us just how chaotic it can get?

The Trial of Diddy

The Prior Bad Acts Question

910.092

Great. And I'm hoping to join you as well.

The Trial of Diddy

The Prior Bad Acts Question

915.716

So for now, that's it. And as we prepare for Diddy's own trial in May, what other trials would you like us to cover? Let us know by email, thetrialatdailymail.com, or you can WhatsApp us on plus44-7796-657512. Start your message with trial.

The Trial of Diddy

1049.146

Welcome back to The Trial of Diddy. We're still here with Tim Patterson. When were you and Sean both introduced to hip hop and how did that connect you together?

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

111.144

Hey, I'm Marjorie Hernandez, DailyMail.com's West Coast News Editor, and welcome to episode 35 of The Trial of Diddy. We're now just five days from jury selection and 12 days from the beginning of the trial itself. We started this podcast back in October of last year thinking maybe there'll be enough material to do one or two shows a month.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

1238.473

What was that like walking into the Uptown Records office with Sean?

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

1281.897

But seeing your childhood friend who used to, as you mentioned, get beat up as a kid to now where he was at 17, being at the helm of a major company. That must have been just a shock to you.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

133.906

Well, now 35 weeks later, we have never missed a week and sometimes we've had to record extra bonus episodes and so much has happened. A huge thanks to everyone who's been with us from the beginning or picked us up over time. Your comments, texts and emails are always welcome. So what's happened this week?

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

1338.053

I have to say, I did speak to some folks who worked at Uptown in those early years. And they alleged that he was sometimes a terror to work with, allegedly, and that he had this temper. And I was just wondering if you ever saw any of that in your dealings with him during those early years at Uptown.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

1435.515

famously Andre Harrell ended up firing him from Uptown. Can you talk a little bit about that and how that went down?

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

153.638

Well, just yesterday, Tuesday, April 29th, Diddy's legal team asked Judge Subramanian to prevent other attorneys from openly commenting on his case. The attorneys claimed that several attorneys represent alleged victims and witnesses continue to muddy the jury pool. with, quote, negative publicity towards her client.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

1626.21

Uptown, during your time there and also obviously Diddy's time there, you guys brought out the biggest artists. You mentioned some of the members of Jodeci. There was Father MC, Mary J. Blige, of course, Heavy Dean Du Bois, Christopher Williams. I mean, what was that like at the height of Uptown under Diddy?

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

1723.541

Do you think because of all the success, he was able to be the exception to the rule that some of the maybe alleged questionable behavior back then, looking at it now from, you know, 2025 lenses, that stuff might not happen now?

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

174.069

Combs' team have specified Douglas Wigdor, who represents Combs' ex Cassie Ventura, for speaking to the media. They attempted to keep the 2016 Los Angeles hallway surveillance video of Diddy pulling and dragging Cassie by the hair from being played for jurors, but the judge ruled it will remain as evidence.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

1802.151

Undeniably, his influence on hip hop and just the culture in general is huge. But the fact that where he is now, his fall from that, you as his personal friend, that must be really difficult. I mean, what's it been like for you seeing that?

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

194.813

Wigdor told DailyMail.com he plans to file a response to the gag order request, saying, "...we will vigorously oppose the motion seeking an extraordinary sweeping gag order as it is an obvious attempt at controlling and silencing victims under counsel in contravention of well-established legal and ethical precedent.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

2026.312

And again, it's important to say that these are just allegations against him. He's facing his trial in a week, actually. But what was your reaction when you actually saw that video of Cassie getting attacked by your friend?

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

2052.053

Like I mentioned before, he's facing very serious allegations and, you know, he could be gone for life. If he is convicted, he could be in prison for life. And I was just wondering, as somebody who's grown up with him, how do you even encapsulate that in your head, that this could be something that could happen to your longtime friend?

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

215.149

Given this, it should come as no surprise that Combs fails to cite even one case to support his requests." Defense attorneys also called out attorney and regular on this pod, Lisa Bloom, who is also representing Don Richard, who was a former member of Combs' girl group, Danity Kane.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

2258.226

So for now, that's it. Thanks again to our guest, Tim Patterson. And as we make final preparations for Diddy's trial in just a few days' time, what other trials would you like for us to cover? Let us know by email, thetrialatdailymail.com, or you can WhatsApp us on plus44-7796-657512 and start your message with trial. As ever, thank you for listening.

Bloom has said Richard, who filed a civil lawsuit against Combs and claims the disgraced bad boy mogul sexually assaulted her, deprived her of food and sleep, and refused to pay her adequately, is in fear for her life.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

247.299

In an exclusive statement to DailyMail.com, Bloom fired straight back at Combs' attorney saying, quote, how hypocritical that Mr. Combs and his attorneys, having made public statements many times, now want to silence me. Accusers and their attorneys have every right to speak out. I am very proud to represent my brave clients, Don Richard and John Doe, in litigation against Mr. Combs.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

272.323

I look forward to attending Mr. Combs' upcoming criminal trial in New York and continue to advocate for my clients consistent with the law and the ethical rules. In other news this week, Diddy's lawyers have claimed he might not have been mentally capable of any alleged crimes due to his drug and alcohol use.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

292.071

The motion, filed on Sunday, April 27th, draws on testimony made by psychiatrist Dr. Eli Aoun. The details of his alleged condition have been redacted in the documents, but there are a few clues that Dr. Aoun will claim that Diddy's mental capacity was affected. Prosecutors are trying to prevent Dr. Irene's testimony and said they don't believe it's relevant.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

316.407

Prosecutors said legal precedent requires a defense to give proper notice before offering any, quote, evidence of effects of drugs and alcohol on a defendant's memory or cognitive function. Another clue in the documents, prosecutors described the doctor's potential testimony as evidence of quote, the defendant's inability to control behavior.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

338.681

To convict someone of a crime, prosecutors need to prove that a defendant committed the crime and had quote, Coming up, we have Diddy's childhood friend and award-winning record producer Tim Patterson. But before we speak to him, it's important to state, as we do every week, that Sean Combs have vehemently denied each and every allegation made in all recent lawsuits filed against him.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

363.56

And he has also denied all the federal charges that have been filed against him. Like everyone else in the legal system, Diddy remains innocent until such time as he has been proven guilty. And with that being said, here we are with Tim Patterson. Hi, Tim. Thanks again for joining us. We are so honored to have you here.

The Trial of Diddy

Very stylish for a three, four-year-old.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

681.207

So Tim, you mentioned your father was an important part and very present in your life. Contrast that with Diddy's dad, Melvin, who actually died when Diddy was around, I think, three years old. Diddy has spoken about Melvin before and said that he was actually a hustler, that he was part of or was associated with a New York drug dealer, Frank Lucas.

The Trial of Diddy

He Was So Interesting To The Hilfigers, The Trumps, The Winfreys

703.173

And we all know that Frank Lucas was portrayed by Denzel Washington, an American gangster. But stepping back to your own dad and his presence, can you talk a little bit about how Sean also became really a part of your family with your dad there and close to you as well?

The Trial of Diddy

As you can see, there's tons of excitement outside, scores of media, and also just curious onlookers who actually, and some of them actually do want to go inside the courtroom and actually get a glimpse or a chance to see Diddy himself. And for Friday's upcoming episode, I mentioned Renato Stabile. He will be back on Friday to give us a wrap up of how he thinks jury selection went, what he thinks was some of the interesting questions that came up during jury selection. I'm wondering if it's because of the rain or more people are planning to possibly go right at the start of trial for opening statements. I think there will be probably more of a crowd of public in general next week.

The Trial of Diddy

Trial Day is JUST Around the Corner

206.355

Well, typically it is boring if you're actually sitting waiting in the courtroom, waiting for your number to be called. However, we have reporter Dan Bates actually sitting inside and watching this all unfold. And some actually pretty interesting points came up from the actual potential jurors.

The Trial of Diddy

So they're given a questionnaire which says, how do you feel about if you hear anything about intimate partner abuse or rape? Do you know these celebrities on this potential witness list? And one of the potential jurors said that, oh, yeah, I actually recognize this name, Mike Myers, who is, as everybody knows, Wayne's World. He's a big actor. Austin Powers. Austin Powers.

The Trial of Diddy

Trial Day is JUST Around the Corner

250.996

So it was interesting. I'm trying to connect Mike Myers and Diddy. So it will be interesting to see who else is on this list. Right now, we do know that, again, Mike Myers and Michael B. Jordan, possibly also on this list, and Kid Cudi.

The Trial of Diddy

Trial Day is JUST Around the Corner

301.047

Right. Again, as Kayla mentioned, even though the celebrities names are out there doesn't necessarily mean they are connected with any of the charges. Also, they might not even be called. This is just a long list of people who might be called. So we'll see how that all shakes out right now. Potential jurors are given this list. And if they feel some sort of way about a witness on there.

The Trial of Diddy

Trial Day is JUST Around the Corner

322.376

They might say, look, I actually worked with this person before. That's why I can't be impartial. So it'll be interesting to see which potential jurors drop off because of that or which actually stay. That's the whole process this week.

The Trial of Diddy

Trial Day is JUST Around the Corner

369.978

And speaking of Albie, famously, you know, him and Kim Porter had dated before and also have a child together, Quincy. Interestingly enough, Terry Garagos, one of the defense attorneys for Diddy, mentioned in court that they expect there to be a discussion about Kim Porter and they might be frequently bringing her up.

The Trial of Diddy

Trial Day is JUST Around the Corner

388.544

During a debate about one potential juror who might be allowed to serve, prosecutor Maureen Comey actually disputed that claim and said that she doesn't think that they're going to bring up Kim Porter a lot. Again, it seems like a small world and being that Diddy just knew everybody and worked with everybody in the industry, there'll be a lot more celebs names coming up in this witness list.

The Trial of Diddy

Trial Day is JUST Around the Corner

449.712

We want to also explain how the UK and US courts differ. In the US, juries are preselected and require a unanimous verdict, whereas UK juries are actually randomly selected and can reach majority verdicts. Also, typically in the U.S. court system, federal cases, no cameras are allowed. So what you're seeing from there are just court artists rendition of what Diddy looks like.

The Trial of Diddy

Trial Day is JUST Around the Corner

476.454

And it's actually been interesting because the court sketches that we're getting right now, Diddy walked in with a, quote, preppy look, according to our reporter again, Dan Bates, who's inside courtrooms. And Diddy is wearing gray pants, navy crew neck sweater, and a crisp white shirt with no tie. And he's still rocking the gray beard and hair.

The Trial of Diddy

Trial Day is JUST Around the Corner

522.222

Another source of mine tell me that hair dye is actually in the commissary list. So he could have actually have his hair did before court. But again, he's still rocking the gray. So we'll see. Interestingly enough, as Kayla's out there standing in the rain. waiting for this jury selection to unfold. Not too far away is the Met Gala that's going to happen later on today.

The Trial of Diddy

Trial Day is JUST Around the Corner

544.506

So interestingly enough, when we're talking about Diddy and how he looks in court, normally he would actually be in prep mode for the Met Gala, which is actually happening tonight. Not seeing him there will be interesting. And Kayla, can you talk a little bit about why this year's Met Gala theme, Diddy would have probably excelled in his outfit?

The Trial of Diddy

Trial Day is JUST Around the Corner

612.344

Right. And we have to always note that he has pled not guilty to all the charges. And he's facing, again, very serious charges, kidnapping, sex trafficking for prostitution, involving at least two victims with male commercial sex workers and racketeering conspiracy. So again, he could actually face potential life sentence if he's convicted of all charges, which again, he has vehemently denied.

The Trial of Diddy

Trial Day is JUST Around the Corner

637.433

We're going to take a quick break and we'll be right back.

The Trial of Diddy

Trial Day is JUST Around the Corner

741.351

Yeah, I had an exclusive this morning. Diddy actually hired a very well-respected jury consultant to join his legal team. And her name is Linda Moreno. And Linda is, again, no stranger to very controversial and high-profile cases. She actually once represented actor Wesley Snipes on his tax evasion case back in 2008. But she's also helped the defense team with other high profile cases.

The Trial of Diddy

Trial Day is JUST Around the Corner

769.297

The one that really put her on the map involved a college professor named Sammy Al-Aryan, who was indicted in 2005 on terrorism charges under the Patriot Act. So she was actually able to help the defense in formulating the questions that jurors would answer individually. and whittle down who would be the best jurors for the defense. And that's really what these jury consultants do.

The Trial of Diddy

Trial Day is JUST Around the Corner

78.715

Another woman has now come forward, alleging Combs of sexual assault. Music mogul and rapper Sean Diddy. He claims she was drugged and sexually assaulted by Combs. Oh, this guy is dangerous.

The Trial of Diddy

Trial Day is JUST Around the Corner

796.392

They look through people's profiles and see if they have anything social media to see whether or not they know the defense or how much they followed up on the defense's posts and case. It's rather controversial, but all legal. They can do their background research on these potential jurors.

The Trial of Diddy

Trial Day is JUST Around the Corner

814.844

So having Linda Moreno there is really interesting that they have hired her to help with picking potential jurors.

The Trial of Diddy

Trial Day is JUST Around the Corner

864.935

Yeah. I'm pretty sure if they haven't shown up by today that they will be there for opening statements on Monday. That is the big day. Maybe the rain had scared off some folks. Who knows? But I'm sure the defense team probably walked around the side to the back door away from the media frenzy outside. jury selection is happening. So they are in there with Diddy.

The Trial of Diddy

Trial Day is JUST Around the Corner

887.789

Actually, there's one picture from the courtroom artist that showed Diddy hugging his defense team right before juries came in. So they're all there next to him. Whether or not we'll see more celebrities or his family members, we shall see next week. One other thing I wanted to bring up related to this jury selection.

The Trial of Diddy

Trial Day is JUST Around the Corner

908.374

Obviously, we're finding out now some of the questions that might come up during the trial itself. They asked whether or not, as a potential juror, whether you've had experiences with domestic partner violence and how you feel about that. And other questions also, have you seen or know anything about this particular celebrity? But, you know, there'll be some jurors who will be dropped off.

The Trial of Diddy

Trial Day is JUST Around the Corner

933.57

They might even have another excuse, a family excuse or something like that. But one of our jury experts, Renato Stabile, actually told us, and he's also a jury consultant like Linda Moreno, he told us there could be some people who actually want to be a part of the jury.

The Trial of Diddy

Trial Day is JUST Around the Corner

951.238

He brought that term up called a stealth juror, that there are people who actually want to sit through an eight-week trial, want to see these celebrities, want to see Diddy. So it'll be interesting to see if any of those stealth jurors will be dropped by either side.

The Trial of Diddy

Trial Day is JUST Around the Corner

988.977

Yeah. It'll be interesting to see who they suss out, who might want to be stealth and try to get in that jury box. But we shall see.

The Trial of Diddy

1040.748

Welcome back to The Trial of Diddy. We're still here with Rochelle Keehan. Now, we obviously were talking about Diddy, who's in trial in his criminal case in New York, but other sources that I've spoken to said he didn't do this alone, this was an enterprise, and that this is why he got away with it, allegedly, for so long.

The Trial of Diddy

It's Not Their Shame, It's His

1060.683

Can you talk about the potential of other charges this could bring about to other folks who are around this circle?

The Trial of Diddy

It's Not Their Shame, It's His

111.451

Hey, I'm Marjorie Hernandez, DailyMail.com's West Coast news editor, and welcome to episode 34 of The Trial of Diddy. At the time of this recording, jury selection starts in just 12 days. It's hard to imagine what's happening on both sides of this case right now. So it's a special episode today as we're devoting the show to someone who will know all about it.

The Trial of Diddy

It's Not Their Shame, It's His

1138.08

Wow. So you're thinking that there could be other, since they went for the big fish, Diddy himself, that there could be potential, I guess, arrests in the future once it all plays out in court.

The Trial of Diddy

It's Not Their Shame, It's His

1157.512

Right. Diddy is facing dozens of civil lawsuits right now. I wonder if that will play also into what happens in criminal court and vice versa.

The Trial of Diddy

It's Not Their Shame, It's His

1197.864

When you have powerful, famous folks like a Sean Combs go to trial for human trafficking and sexual assault cases, how do you think that affects how the public sees these cases?

The Trial of Diddy

It's Not Their Shame, It's His

1262.948

You brought up a good point that when you think about human trafficking, you think, you know, a boogeyman who comes and kidnaps a child or a woman and puts them into sex slavery, essentially. But it's not often that at all. It's somebody who they trusted.

The Trial of Diddy

It's Not Their Shame, It's His

1285.419

Or my former boyfriend.

The Trial of Diddy

It's Not Their Shame, It's His

1287.282

One of the things I guess I am interested in is, as you mentioned before, the kind of delicate line that prosecutors have to walk because if you call too many of these prior bad act witnesses, it could backfire.

The Trial of Diddy

It's Not Their Shame, It's His

133.028

Rochelle Keen is a former special victims prosecutor and founder of Collective Liberty, an organization dedicated to eradicating sex trafficking. Rochelle has an amazing resume. Her work has led to the arrest of over 1,000 human traffickers and the training of over 3,000 investigators.

The Trial of Diddy

It's Not Their Shame, It's His

1412.13

Now, obviously, the trial hasn't started yet. It's Vardir. I think jury selection starts May 5th. But for you as a prosecutor, somebody who is working diligently with your organization to shed a light on human trafficking, what do you think this case will do in terms of getting the word out there about human trafficking and violence against women?

The Trial of Diddy

It's Not Their Shame, It's His

1504.961

So for now, that's it. Thanks again to our guests, the brilliant Rochelle Keehan. And as we prepare for Diddy's own trial in May, what other trials would you like us to cover? Let us know by email, thetrialatdailymail.com, or you can WhatsApp us on plus44-7796-657512 and start your message with trial. As ever, thank you for listening.

The Trial of Diddy

It's Not Their Shame, It's His

175.158

But before we speak to her, it's important to state, as we do every week, that Diddy has vehemently denied each and every allegation made in all recent lawsuits filed against him, and he's also denied all the federal charges to have been filed against him. Like everyone else in the legal system, he remains innocent until such time as he is proven guilty.

The Trial of Diddy

It's Not Their Shame, It's His

196.378

And with that being said, here we are with Rochelle Keehan. Thank you so much for appearing on the pod, Rochelle.

The Trial of Diddy

It's Not Their Shame, It's His

204.462

Can you tell us a little bit more about your background and the collective liberty?

The Trial of Diddy

It's Not Their Shame, It's His

239.864

And it's definitely a problem worldwide. The good work that you're doing out there is just highlighting that. But in connection with the Diddy case, however, obviously he is facing trafficking charges as well in this federal case out in New York. Just to give our listeners a little update on the case itself. So Diddy appeared in court last Friday, April 18th.

The Trial of Diddy

It's Not Their Shame, It's His

It's Not Their Shame, It's His

262.157

And there was a lot of pretrial motions that was discussed. I'm sure Rochelle can go over that with us. One of the things that happened is the judge did allow three alleged victims to testify under their pseudonyms and not their true legal names, but Cassie Ventura, who's Diddy's ex, plans to testify under her name.

The Trial of Diddy

It's Not Their Shame, It's His

280.446

But something else that happened that I was hoping Rochelle can dive into, the judge also issued a very important order that was pretty much a win for Diddy by granting his motion to exclude testimony about prior bad acts from all but one proposed witness. And I was hoping you can explain what are prior bad act witnesses and also how this decision could affect the case itself.

The Trial of Diddy

It's Not Their Shame, It's His

438.267

That's interesting. So it can be argued again at some point during trial whether or not these uncharged victims could come in and testify. Yeah.

The Trial of Diddy

It's Not Their Shame, It's His

454.883

One of the interesting things I also saw that a minor might be a possible witness. And we haven't seen an actual, again, charge involving a minor in the allegations against Diddy. However, how does that play in the case?

The Trial of Diddy

It's Not Their Shame, It's His

541.235

Now Diddy has claimed his innocence. He said he's not guilty. And he says that these were all consensual threesomes and these alleged freak offs. But you know, in a case like this, it does come down to he said, she said, and I was wondering how how do you prep your witnesses as a prosecutor in such a case like this? And in this case, it's a huge case against a celebrity.

The Trial of Diddy

It's Not Their Shame, It's His

64.661

I'm DailyMail.com journalist Marjorie Hernandez. And over the last six months, I've been investigating this incredible story and speaking to the people in the eye of the storm. Welcome to the Trial of Diddy.

The Trial of Diddy

It's Not Their Shame, It's His

669.775

But can you also talk about how Cassie's decision to actually come out and use her own name in court, how that could also affect the case and even how jurors might perceive her?

The Trial of Diddy

It's Not Their Shame, It's His

740.151

You mentioned that video. That was a 2016 video of Cassie fleeing inside a hotel hallway. She was trying to go down the elevator and we see Diddy pulling her back by her hair. which that video was released by CNN and went viral. Can you tell me how important that video was to this case?

The Trial of Diddy

It's Not Their Shame, It's His

763.955

And also the fact that he's not being charged with battery and sexual assault, like you said, but why this particular video is so important.

The Trial of Diddy

It's Not Their Shame, It's His

844.88

Right. And obviously Diddy's attorneys is trying to keep that Cassie video out of the trial and also other videos as well. So we shall see what actually ends up in front of the jury. And speaking about, you know, consent, the other uncharged victims said, The fact that they also allegedly went through this with him, but there's no sexual assault or even arrest of Diddy for all these years.

The Trial of Diddy

It's Not Their Shame, It's His

871.277

How do you think that will play out in court when they finally have a chance to testify, even though they're not named as victims on the complaint?

The Trial of Diddy

It's Not Their Shame, It's His

965.711

There's so much more coming up. But for now, let's pause for a break.

The Trial of Diddy

All He Has Is Kanye in His Corner

1042.316

Now, there was some discussion at Diddy's hearing last week that the jury might possibly be sequestered or that there might be some indication that could be a possibility. Do you think this will actually happen in this case?

The Trial of Diddy

All He Has Is Kanye in His Corner

1094.001

That's interesting. You think that because there's more access to media and all of that, that there would be a sequester. But I guess taking from your standpoint, like there's it's really almost an impossibility to even avoid that. But the judge does tell the jurors that they're not supposed to read and consume any news having to do with the case.

The Trial of Diddy

All He Has Is Kanye in His Corner

1127.969

I mean, just the sheer thinking of even trying to sequester a jury for this case and how long it could take. I don't recall how much sequestering the O.J. Simpson case jurors were, but they were out there for like eight and a half months or something, right?

The Trial of Diddy

All He Has Is Kanye in His Corner

1145.382

Now, one of the more talked about developments from last week's hearing was actually Diddy's physical appearance. And it sounds like he is giving up on dying his hair and he was noticeably gray and had gained some weight. Now, we actually had a reporter out there, Dan Bates. He's covered the case for a while now, and he was actually shocked to see how Diddy looked.

The Trial of Diddy

All He Has Is Kanye in His Corner

115.737

And I'm Marjorie Hernandez, DailyMail.com's West Coast news editor.

The Trial of Diddy

All He Has Is Kanye in His Corner

1167.949

And he had wondered, you know, could this be a way for Diddy to gain some sympathy? from potential jurors now that he's getting ready for trial. And I was wondering, you know, what your thoughts were on that.

The Trial of Diddy

All He Has Is Kanye in His Corner

1230.094

Christina Karam, who's Diddy's senior executive chief of staff of Bad Boy, or formerly, has actually broken her silence and issued a statement. For our listeners, she actually has also been named on at least three different civil cases along with Diddy, and those civil cases have having to do with sexual assault allegations. And I was wondering, now that she's

The Trial of Diddy

All He Has Is Kanye in His Corner

124.355

Oh, busy as always. There's always something going on with this case. And today, our friend of the pod, Megan Kuniff, reporter, she just tweeted that attorney Tony Busby has moved to withdraw from seven more lawsuits against Sean Diddy Combs after a judge called him out for not being admitted to practice in the Southern District of New York. And I believe he also did so the other day.

The Trial of Diddy

All He Has Is Kanye in His Corner

1254.722

broke her silence, do you think that this will actually play a role in that Christina might be called? Well, it depends who we're talking about, right?

The Trial of Diddy

All He Has Is Kanye in His Corner

1273.82

One other interesting thing that broke earlier this week was this video between Diddy and Kanye. I guess Diddy had called Kanye and Kanye recorded himself talking to Diddy over Zoom. It's a jail phone call. And essentially, Diddy was telling Kanye, you have to look out and, you know, you have to take care of yourself. And it was a really interesting exchange.

The Trial of Diddy

All He Has Is Kanye in His Corner

1299.227

I was wondering if you saw it, first of all, Lewin, and if you have any thoughts on it. And could that even actually play somehow in the criminal trial?

The Trial of Diddy

All He Has Is Kanye in His Corner

1330.666

So if you're defending Diddy and he's getting ready to fight for his life, former friends are now, you know, distancing themselves from him. What do you say to him now that he's weeks into, again, fighting for his life in court?

The Trial of Diddy

All He Has Is Kanye in His Corner

1428.496

And again, you mentioned right now there's three victims. However, can they call other potential witnesses that could testify to maybe a pattern of abuse that Diddy has allegedly had over other folks?

The Trial of Diddy

All He Has Is Kanye in His Corner

1479.668

A case like this, do you think it'll take weeks, months? What's your prediction on that?

The Trial of Diddy

All He Has Is Kanye in His Corner

148.953

So this now makes sense. I believe, eight notices essentially saying that he cannot represent the plaintiffs in the case because he possibly is not able to practice in that area, Southern District of New York.

The Trial of Diddy

All He Has Is Kanye in His Corner

1518.871

Obviously, we're waiting for May 12th when the criminal case will start, but he's also facing a slew of allegations in civil court. There's more than 30 now of cases against him. As he's going through his federal trial, what happens to those cases?

The Trial of Diddy

All He Has Is Kanye in His Corner

1550.106

Right. I wonder if some of those potential witnesses or folks who have actually filed against him could be even called in his criminal case. We shall see.

The Trial of Diddy

All He Has Is Kanye in His Corner

1561.633

What do you expect in terms of trial preparation to gear up for May 12th?

The Trial of Diddy

All He Has Is Kanye in His Corner

1599.764

When you talked about the list, you're talking about the questionnaire, the voir dire.

The Trial of Diddy

All He Has Is Kanye in His Corner

1659.898

It'll be also interesting to see who the jury poll would be because Diddy is such a huge figure, obviously in New York, globally, he's known all over. So to pick a jury that hasn't heard much about him or are the allegations against him, is that close to impossible?

The Trial of Diddy

All He Has Is Kanye in His Corner

1696.344

We'll see how that all shakes down in just a few weeks. It looks like it's in a steady pace to actually move forward in May.

The Trial of Diddy

All He Has Is Kanye in His Corner

1730.316

As ever, thank you for listening. Please share all your comments, suggestions, and thoughts on The Trial of Diddy on Apple or Spotify and follow us on TikTok at Daily Male Crime. Do follow The Trial of Diddy as we will be here each week with fresh information, new insights, and some expert guests. Goodbye.

The Trial of Diddy

All He Has Is Kanye in His Corner

185.262

Right. A few weeks ago, he went on his Instagram and said that, look, I am able to practice since 2019. So that doesn't stop me from being involved in these cases. But it is quite shocking that he's now pulling himself out of at least eight cases now. So we'll see what will happen there because he has been, like you said, Kayla, the face of these cases.

The Trial of Diddy

All He Has Is Kanye in His Corner

209.335

Now, we've reached out to Tony Busby for comment, but in the meantime, Tony Busby has posted something on his Instagram. And it reads, quote,

The Trial of Diddy

All He Has Is Kanye in His Corner

233.267

Is it true that after I brought cases against certain celebrities for alleged sexual abuse that an army of unscrupulous New York investigators illegally solicited a large number of my former clients and offered them money to file frivolous cases against me and my firm? Yes, that's certainly true. The transcripts don't lie. Are they trying to discredit me? They certainly are trying.

The Trial of Diddy

All He Has Is Kanye in His Corner

25.791

At the height of his career, Sean Diddy Combs had it all. It seemed like everything Diddy touched turned to gold. Now the once untouchable hip-hop mogul is fighting for his life as he faces multiple federal charges in New York, including sex trafficking and allegedly running a criminal enterprise.

The Trial of Diddy

All He Has Is Kanye in His Corner

257.482

Did a few former clients take the bait and file a few cases? Unfortunately so. One of those cases has already been tossed and I expect the other two will be tossed as well. But am I under siege? That's a bit dramatic. I don't feel that I am unless you consider being accosted by a miniature donkey and

The Trial of Diddy

All He Has Is Kanye in His Corner

278.789

to be under siege and in the post there is a picture of mr busby in a truck next to a donkey that is again from texas-based attorney tony busby and we will bring you his comment if and when we get one from him

The Trial of Diddy

All He Has Is Kanye in His Corner

310.014

Yeah, that's right. And I think it's worth saying that a lot of people were surprised about Diddy's physical appearance in the courtroom last week. We had a reporter there and he said Diddy let his hair grow out white, that he has a new white beard and he might actually also put on some weight as well. So there's this whole new older man look going on with Diddy right now.

The Trial of Diddy

All He Has Is Kanye in His Corner

332.085

Now he is accused of running a decades long criminal empire, including orgies. now infamously known as freak-offs, where participants were allegedly drugged and forced into lengthy sex sessions, sometimes with male prostitutes.

The Trial of Diddy

All He Has Is Kanye in His Corner

399.179

In a remarkable burst of activity this week, Christina Karam, who is Diddy's former chief of staff, has given a statement to Rolling Stone reporter Cheyenne Roundtree. In it, Karam, who's been named in three lawsuits associated with Diddy, said the accusations against her were, quote, disturbing and unthinkable.

The Trial of Diddy

All He Has Is Kanye in His Corner

417.504

And she denied that she ever, quote, condoned or aided and abetted the sexual assault of anyone, nor have I ever drugged anyone.

The Trial of Diddy

All He Has Is Kanye in His Corner

462.742

And of course, when Cassie Ventura filed her lawsuit against Diddy for physical assault and rape, Karam was witnessed sitting by Combs in Miami. That case was, as you'll remember, settled the following day despite Combs trying to deny the claims.

The Trial of Diddy

All He Has Is Kanye in His Corner

477.53

In February of last year, producer Rodney Little Rod Jones claimed Karam was then, quote, Ghislaine Maxwell to Sean Combs' Jeffrey Epstein in his own sexual harassment and assault lawsuit against Diddy.

The Trial of Diddy

All He Has Is Kanye in His Corner

536.972

Combs's lawyers have, as we have stated many times, denied all claims, saying, quote, no matter how many lawsuits are filed, it won't change the fact that Mr. Combs has never sexually assaulted or sex trafficked anyone, man or woman, adult or minor.

The Trial of Diddy

All He Has Is Kanye in His Corner

586.592

On his call, Diddy instructed Kanye to, quote, have some effing fun and to, quote, get behind the mic. Now, there has been some online speculation about the recording's authenticity, but the Post's source confirmed that the call was real and not A.I.,

The Trial of Diddy

All He Has Is Kanye in His Corner

602.916

And Kanye being Kanye, he sampled some of Diddy's warm words from the call and used them as an intro for a new song called Lonely Road Still Go to Sunshine. That last Saturday, he shared a snippet of in a since deleted post on X. We'll also definitely get into that with Lou Shapiro in this week's interview.

The Trial of Diddy

All He Has Is Kanye in His Corner

Well, welcome back to The Trial of Diddy. And today we have attorney and legal analyst Lou Shapiro. Thanks so much, Lou, for coming back to our show.

The Trial of Diddy

All He Has Is Kanye in His Corner

64.673

I'm DailyMail.com journalist Marjorie Hernandez, and over the last six months, I've been investigating this incredible story and speaking to the people in the eye of the storm. Welcome to the Trial of Diddy.

The Trial of Diddy

All He Has Is Kanye in His Corner

650.942

Yes. And can you kindly tell us first your background in federal criminal courts?

The Trial of Diddy

All He Has Is Kanye in His Corner

670.117

He has a lot of experience with analyzing a lot of these big cases. So very fortunate to have you on the show. Now, Lou, a lot has happened since we last spoke. Diddy is now in a federal lockup since, gosh, September 16th. He has remained there for, gosh, despite several attempts to be released on bail. And now actually it looks like the May 5th court date will be pushed back by a week.

The Trial of Diddy

All He Has Is Kanye in His Corner

697.645

The trial looks like it's going to start now on May 12th. Now, do you anticipate that it will actually move forward on May 12th?

The Trial of Diddy

All He Has Is Kanye in His Corner

719.827

And just today, as you mentioned, the federal prosecutors were told to hand over the names of those three alleged victims who are, again, connected to the federal criminal indictment. And the judge's order said their identities were disclosed to Diddy's attorneys, quote, under attorney's eyes only designation. Can you explain what that means?

The Trial of Diddy

All He Has Is Kanye in His Corner

741.441

Since Diddy's own attorneys had previously referred to Cassie as victim one.

The Trial of Diddy

All He Has Is Kanye in His Corner

776.138

But the fact was, I think Diddy's attorneys actually also said that the other victims were possible former girlfriends. Would that affect the case in terms of what will be discussed moving forward now that these names are sealed for now?

The Trial of Diddy

All He Has Is Kanye in His Corner

801.73

Now, how about witnesses in the case? There hasn't been a release of any witness lists as far as we've heard, but could that be made available or made public anytime soon?

The Trial of Diddy

All He Has Is Kanye in His Corner

846.431

Wow. Given the fact that these allegations span years and also given who the defendant is, what do you expect that witness list to look like? Some A-listers possibly?

The Trial of Diddy

All He Has Is Kanye in His Corner

885.542

You talked a little bit about the gag order. So how will that work? Will the public not learn the names of the folks in the witnesses until trial starts? Or will that be released earlier? Like we're now in the pretrial motion phase, right?

The Trial of Diddy

All He Has Is Kanye in His Corner

923.993

Now, can the judge actually close the court when victims one, two, and three testify?

The Trial of Diddy

All He Has Is Kanye in His Corner

950.51

So then the witness's testimony will not be public or the transcript would be sealed? Is that what will happen or what could happen?

The Trial of Diddy

All He Has Is Kanye in His Corner

962.322

So the transcripts of the testimony would be public, but their names will be kept out. I know like the Weinstein case, it was an open court and they did testify in person. I guess some of their names were not made public, right?

The Trial of Diddy

Millions and Millions of Dollars

1035.981

And of course, he's maintained that he's innocent with all these civil cases. So we'll see, as you said, how it will pan out in court.

The Trial of Diddy

Millions and Millions of Dollars

1070.925

Can we talk a little bit about that? I mean, because of that one particular case, and this is the one involving, I believe, the woman who alleged that she was 13 years old when this assault happened. Could this affect other cases, the other civil lawsuits?

The Trial of Diddy

Millions and Millions of Dollars

1127.839

And now even if he does, again, we're still far away from the criminal trial. So looking at that crystal ball, what happens if it does keep moving forward? Does that delay all of his civil cases as well?

The Trial of Diddy

Millions and Millions of Dollars

1223.951

So essentially, he will be in and out of courts possibly for years and years to come.

The Trial of Diddy

Millions and Millions of Dollars

1348.373

Welcome back. And we're still here with legal analyst and attorney Kelly Hyman.

The Trial of Diddy

Millions and Millions of Dollars

152.782

Yes, Diddy has been charged under the Mann Act, which is also known as the White Slave Traffic Act, which is a 1910 federal law prohibiting transporting people for prostitution.

The Trial of Diddy

Millions and Millions of Dollars

164.35

Now, Diddy's lawyers have said that the law has historically been used disproportionately against Black men, citing rock and roll pioneer Chuck Berry and early 20th century's most famous boxer, Jack Johnson, who was actually known as Galveston Giant, as examples.

The Trial of Diddy

Millions and Millions of Dollars

1698.432

There's so many things still up in the air, obviously, as we move forward and possibly more cases will be filed. But were you shocked that there was a superseding indictment filed in this case?

The Trial of Diddy

Millions and Millions of Dollars

182.103

The lawyers allege that, quote, no white person has ever been the target of a remotely similar prosecution, pointing out former New York Governor Eliot Spitzer's case where escorts were charged, but he was not. Now, Diddy claims that he's being singled out because of his race and being, quote, prosecuted for conduct that regularly goes unpunished because he is a powerful black man.

The Trial of Diddy

Millions and Millions of Dollars

1940.311

Kelly, you know, Diddy is obviously fighting for his life. He's, as you mentioned, he's also himself have gone after NBC Universal, News Nation, filing these other lawsuits. But how is it going for both sides, for both the prosecution and Diddy's team?

The Trial of Diddy

Millions and Millions of Dollars

2322.566

What a lot of people also are curious about are the potential witnesses. As you mentioned, Cassie is more than likely one of the alleged victims mentioned in the criminal suit. But, I mean, Diddy had his hands and knew everybody. A-listers, everybody you know, went to his parties.

The Trial of Diddy

Millions and Millions of Dollars

2339.073

And I was just wondering what your thought was on that, that there could be some very interesting people who will be up on that stand.

The Trial of Diddy

Millions and Millions of Dollars

2378.56

Kelly, you also mentioned, obviously, that video, I think it was 2016, of Cassie. We see that Diddy had dragged her from the hotel hallway. But there's also another video that Diddy posted weeks after, and that was his apology in reference to that video. And I was just wondering, do you think that would be included as well?

The Trial of Diddy

Millions and Millions of Dollars

2483.155

So for now, that's it. And thanks again to this week's guest, Kelly Hyman. Great to have her on the pod. And as we prepare for Diddy's trial in May, or whenever it might actually be, what other trials would you like for us to cover? Let us know by email, thetrialatdailymail.com, or you can WhatsApp us on plus44-7796-6571. 512 and start your message with trial.

The Trial of Diddy

Millions and Millions of Dollars

Millions and Millions of Dollars

270.606

Diddy has always, and it's important to say, vehemently denied all the allegations he's faced and he's pleaded not guilty after charges were initially filed. His lawyers told DailyMail.com, quote, Mr. Combs and his legal team have full confidence in the facts and the integrity of the judicial process.

The Trial of Diddy

Millions and Millions of Dollars

288.998

In court, the truth will prevail that Mr. Combs never sexually assaulted or trafficked anyone, man or woman, adult or minor. And as we know, he has been denied bail three times by two separate judges, and he will remain in jail until his criminal trial starts, which as of today has been scheduled for May 5th. He is facing life in prison. if he is found guilty of the racketeering charge.

The Trial of Diddy

Millions and Millions of Dollars

465.694

Yeah, the lawsuit mentioned it was a female celebrity, but was never named.

The Trial of Diddy

Millions and Millions of Dollars

475.996

Okay, and with that, let's welcome this week's guest, legal analyst and trial attorney, Kelly Hyman. Hello, Kelly.

The Trial of Diddy

Millions and Millions of Dollars

496.723

Well, Diddy's lawyers actually asked the judge dismiss count three of his superseding indictment. And what was interesting is his argument or his attorney's argument that this no white person has ever been targeted of this similar charge. And they're claiming that because he's a powerful black man, that he's being targeted for that charge. And I was wondering what your thoughts were on that.

The Trial of Diddy

Millions and Millions of Dollars

523.96

You know, is this just another way the attorneys are trying to get him off?

The Trial of Diddy

Millions and Millions of Dollars

566.519

And that third count is transportation to engage in prostitution. Just wanted to clarify that. But do you think the argument actually does stand a chance?

The Trial of Diddy

Millions and Millions of Dollars

630.149

Could this possibly become a separate hearing?

The Trial of Diddy

Millions and Millions of Dollars

64.658

I'm DailyMail.com journalist Marjorie Hernandez, and over the last six months, I've been investigating this incredible story and speaking to the people in the eye of the storm Welcome to the Trial of Diddy.

The Trial of Diddy

Millions and Millions of Dollars

687.119

I was just wondering also, there are now, gosh, over 30 civil lawsuits against Diddy. And, you know, they keep coming, as Kayla said, Now, these are, again, mostly individual lawsuits because each victim claims specific incidents and within different time frames.

The Trial of Diddy

Millions and Millions of Dollars

705.432

But could there be a possibility that there could be a class action suit filed against maybe not Diddy himself, but his company, his record company?

The Trial of Diddy

Millions and Millions of Dollars

845.689

Now, Kelly, could there a possibility that maybe at some point the AG's office could step in and maybe put together a victim's compensation fund like they did with the Harvey Weinstein victims and Jeffrey Epstein victims also were being paid from a fund through his estate?

The Trial of Diddy

Millions and Millions of Dollars

954.465

Now, Kelly, going back to, I'm sorry to harp on the victim compensation fund, because I found that very interesting. When it comes to the Jeffrey Epstein victims, they received the money through his state because he did pass away in jail. In the Harvey Weinstein case, it was found that his companies, his employees were victims because of, and the AG did it through his companies.

The Trial of Diddy

Millions and Millions of Dollars

979.722

But I was just wondering how something like this could possibly work out if it's under bad boy records or any other entities that worked with Diddy.

The Trial of Diddy

BREAKING NEWS Motion Denied (Again)

102.458

As we mentioned on the main episode this week, a few days ago, the defense lawyers wrote to the judge claiming the prosecutors have been slow to turn over some potential evidence for review, including materials relating to a superseding indictment returned by a grand jury earlier this month. These actions have, they say, made it difficult for them to fully be ready in three weeks.

The Trial of Diddy

BREAKING NEWS Motion Denied (Again)

124.987

Now, Diddy's lawyers say some evidence have yet to be released to them includes materials related to a count in the indictment that carries a 15 year mandatory minimum prison sentence if a conviction is cured. In reaction, they wrote, quote, We cannot in good conscience go to trial on the scheduled date. This is a problem that the government has created, yet it opposes our reasonable requests.

The Trial of Diddy

BREAKING NEWS Motion Denied (Again)

149.367

As we know, prosecutors opposed the request and the judge said he would address the issue during a hearing that was scheduled for today, Friday. And now he has and the request has been denied with a judge saying jury selection for the trial will begin on May 5th as scheduled. Adding, quote, it is unclear why there isn't sufficient time to prepare.

The Trial of Diddy

BREAKING NEWS Motion Denied (Again)

171.219

Diddy has of today been held without bail for 213 days since his arrest last September. And he has vehemently denied every allegation made in all recent lawsuits filed against him. And he also has denied all federal charges that have been filed against him. But that wasn't all that happened today.

The Trial of Diddy

BREAKING NEWS Motion Denied (Again)

189.272

Diddy's attorneys also asked the judge to order former girlfriend Cassie Ventura to turn over the draft of her memoir and notes. Although she's actually not named in that motion, Diddy's attorney, Mark Agnafillo, has claimed Cassie wrote a book about him that he could, quote, catch and kill for $30 million, which is according to TMZ.

The Trial of Diddy

BREAKING NEWS Motion Denied (Again)

213.395

Cassie's attorneys filed a motion to block this and claimed that he even wanted her bank statements. The judge ruled that Cassie must turn over her memoir drafts by April 25th, but not her financial statements. Diddy's attorneys also filed a motion to block the now viral CNN video of Diddy attacking Cassie at an LA hotel back in 2016.

The Trial of Diddy

BREAKING NEWS Motion Denied (Again)

237.432

They claimed the video was edited to make Diddy look more menacing compared to the original hotel surveillance footage. They also claimed CNN destroyed that footage. CNN denying the allegations asserts that it neither altered the footage nor discarded the original, which it says remains with the source.

The Trial of Diddy

BREAKING NEWS Motion Denied (Again)

BREAKING NEWS Motion Denied (Again)

257.264

On Friday, the judge also denied an attempt by Warner Brothers Discovery to hold back outtakes from its Fall of Diddy docuseries from January of this year. Specifically, the footage the defense want to see involves a former employee of Combs' and an ex-girlfriend.

The Trial of Diddy

BREAKING NEWS Motion Denied (Again)

274.556

Warner Brothers Discovery attempted to use reporters' privilege to keep the outtakes out of the case, but the judge rejected that notion because both of the individuals in the footage seem likely to be giving testimony in the trial, and therefore the outtakes are deemed relevant and admissible. As we're recording this episode, they're actually still in court, but we do have a reporter inside.

The Trial of Diddy

BREAKING NEWS Motion Denied (Again)

298.34

So we're hoping to check back with our reporter and get more information as it comes. Thanks for listening. We'll be back before you know it.

The Trial of Diddy

BREAKING NEWS Motion Denied (Again)

Welcome to The Trial of Diddy. Hey, I'm Marjorie Hernandez, DailyMail.com's West Coast news editor. And welcome to a special bonus episode of The Trial of Diddy on the day Sean Combs' attorneys asked Judge Aaron Cerbermanian to delay his May 5th trial by two months so they can better prepare for their defense.

The Trial of Diddy

Trials Are a Crapshoot

119.413

And I'm Marjorie Hernandez, DailyMail.com's West Coast news editor.

The Trial of Diddy

Trials Are a Crapshoot

1192.592

We have so much more coming up, but for now, let's pause for a break.

The Trial of Diddy

Trials Are a Crapshoot

1250.62

I do have to ask, Cassie also filed a lawsuit against Diddy, and she settled with him last year. I was wondering what the optic is on that because, you know, obviously he's fighting this criminal case, but she settled. So the fact that he settled, does that play into the argument that, look, she consented?

The Trial of Diddy

Trials Are a Crapshoot

138.411

My family's fine, thankfully. We did not have to evacuate. But so many thousands of other Angelenos have had to do so and also have lost their homes. And there's been lives that have been lost. So it's really hard out here for our city. But the one silver lining that has happened is seeing the people of Los Angeles really coming together and supporting each other and volunteering.

The Trial of Diddy

Trials Are a Crapshoot

1606.482

Going back to the whole paternalistic thing, I think that was very interesting.

The Trial of Diddy

Trials Are a Crapshoot

1610.705

One of the more interesting arguments that these attorneys made was that they claimed the prosecution was being sexist for allegedly taking on, quote, a paternalistic role by saying that they need to protect women who can't be trusted to make their own decisions about what type of sex they have or their sexual partners. And I was just wondering what you thought about that argument.

The Trial of Diddy

Trials Are a Crapshoot

taking care of our first responders and our firefighters out there. So that does give me some hope, but we're going to rebuild hopefully. And we're doing okay as we can.

The Trial of Diddy

Trials Are a Crapshoot

1684.07

Do you think that they'll argue over this release of the tapes in a future hearing, or will the judge make a decision about the tapes?

The Trial of Diddy

Trials Are a Crapshoot

1723.033

You brought up another point earlier also when you said that this could factor into maybe a deal, a plea deal. Now, we don't know whether or not that has been offered to Diddy, but the fact that this is out there is interesting. And I was just wondering what your thoughts were on that, because Diddy has said, I'm innocent. We're going to go to trial. I'm going to prove my innocence.

The Trial of Diddy

Trials Are a Crapshoot

1745.857

Everybody.

The Trial of Diddy

Trials Are a Crapshoot

1842.222

Right. I've seen cases where it actually went to trial and then all of a sudden it stops and they take a deal.

The Trial of Diddy

Trials Are a Crapshoot

1941.249

So, David, do you think Diddy will ever get out of jail?

The Trial of Diddy

Trials Are a Crapshoot

2009.79

Thank you so much. So for now, that's it. Thanks again to David Gellman for coming on the show. It's always a pleasure to have him on. 2025 really is shaping up to be a very interesting year for Diddy and everyone who's part of this case.

The Trial of Diddy

Trials Are a Crapshoot

As ever, thank you for listening. Please share all your comments, suggestions, and thoughts on The Trial of Diddy on Apple or Spotify and follow us on TikTok at Daily Male Crime. Do follow Trial of Diddy as we will be here each week with fresh information, new insights, and some expert guests.

The Trial of Diddy

Trials Are a Crapshoot

244.542

All right. That's right, Kayla. And what's more, Diddy's lawyers are saying that these tapes will absolve him of all and any wrongdoing and show that the world that this was. you know, quote, a private sexual activity between himself and his then partner, Cassie Ventura.

The Trial of Diddy

Trials Are a Crapshoot

Trials Are a Crapshoot

260.203

Prosecutors initially refused to hand over the videos after Combs was charged and his lawyers only got to see their contents at the end of last year. Now, the contents of the videos has been kept secret because of Ventura's attorneys requesting that they not be released to protect her own privacy and But, which was a request that the government did agree to.

The Trial of Diddy

Trials Are a Crapshoot

282.166

Now this has meant that these attorneys are only able to view them under law enforcement supervision. And now they're asking for fuller access.

The Trial of Diddy

Trials Are a Crapshoot

320.524

What's striking is this letter states, quote, and fairly minded viewer of the videos will quickly conclude that the prosecution of Mr. Combs is both sexist and puritanical. It is sexist because the government's theory perpetuates stereotypes of female victimhood and lack of agency.

The Trial of Diddy

Trials Are a Crapshoot

337.488

The prosecutors reflects a paternalistic view that the government is here to protect women who cannot be trusted to make their own decision about sex. and are not capable of consenting to sex that the prosecutors view as outside the norm, end quote. Now we'll be talking to David Gellman about this letter in this episode.

The Trial of Diddy

Trials Are a Crapshoot

356.604

And I don't know about you, Kayla, but I'm very interested to know what he makes of this.

The Trial of Diddy

Trials Are a Crapshoot

362.498

Now, Diddy is, of course, locked up in Brooklyn's Metropolitan Detention Center in New York after his arrest back in September of 2024, and he's facing federal criminal charges in a sex trafficking and racketeering conspiracy. Now, Diddy has pleaded not guilty to all the accusations, and both he and his legal team have repeatedly and strongly asserted his innocence.

The Trial of Diddy

Trials Are a Crapshoot

406.12

Yes. This week, Diddy's attorneys had filed another motion asking the court to force the prosecution essentially to release Marjorie. I believe it's nine videotapes having to do with the allegations with victim number one, which we all know is Cassie. And they're saying that prosecution should turn over these videos of Diddy and Cassie because they need to review the videos in its entirety.

The Trial of Diddy

Trials Are a Crapshoot

430.342

Now, David, just wanted to find out from your perspective, why is this important? And also their argument is the prosecution is trying to protect, quote unquote, Cassie and the victim. in paternalistic sexist manner. And I was wondering what your take was on that argument.

The Trial of Diddy

Trials Are a Crapshoot

46.072

Music mogul and rapper Sean Diddy Combs has faced four different lawsuits in recent weeks alleging sexual assault. I'm DailyMail.com journalist Marjorie Hernandez.

The Trial of Diddy

And over the last six months, I've been investigating this incredible story and speaking to the people in the eye of the storm. Welcome to the trial of Diddy.

The Trial of Diddy

Trials Are a Crapshoot

666.852

So at this point, David, prosecution would have to respond to this memo that was sent by Diddy's attorney. Is that correct?

The Trial of Diddy

Trials Are a Crapshoot

755.393

Yeah, from my reading, there is a protection currently on them, but they want to amend that protection in order to allow Diddy to, I guess, have more access to all of the footage.

The Trial of Diddy

Trials Are a Crapshoot

786.65

Do you think that there will be a hearing just specifically on these videotapes?

The Trial of Diddy

Trials Are a Crapshoot

900.845

You know, obviously, we're talking about his criminal case right now, but he is facing what I think over 25 civil lawsuits right now. I think it probably has gone up to 30. And a lot of those lawsuits have accusations involving minors at the time of the incidents. So far, there hasn't been a new indictment against Diddy or added charges.

The Trial of Diddy

Trials Are a Crapshoot

925.008

And I was wondering what your take on that is, is whether or not there could be in the horizon a separate criminal case against him, or would they amend the charges that he's currently facing?

The Trial of Diddy

A Jury of His “Peers”

1064.582

Well, thank you so much for breaking all that down. I know there is just a lot to digest in the week of just jury selection. So you can imagine what the next, what, eight to 10 weeks will be like in the actual beginning of this trial.

The Trial of Diddy

A Jury of His “Peers”

1086.667

Well, thank you again, Renato, for taking the time out to speak to us and lending us your expertise. We would love to have you back on again as this trail progresses. That'd be great. Thanks a lot for having me.

The Trial of Diddy

A Jury of His “Peers”

112.523

Another woman has now come forward, alleging Combs of sexual assault. Music mogul and rapper Sean Diddy. She claims she was drugged and sexually assaulted by Combs. Oh, this guy is dangerous.

The Trial of Diddy

A Jury of His “Peers”

1190.706

I mean, we've heard a lot of them before. Mark Agnefo. I mean, he was the defense attorney for the next sex cult leader, Keith Raniere.

The Trial of Diddy

A Jury of His “Peers”

1248.25

Right. Like you said, he's not officially on the defense team. However, Mark, who's had so many celebrity cases throughout the years, he has been, I guess, off and on throughout the years, a legal counsel for Diddy and other organizations. Oh, he's a long time ally. They have a long term relationship for years now.

The Trial of Diddy

A Jury of His “Peers”

1268.652

And so it's interesting and not surprising that Tenney jumped on as one of the main defense attorneys. But one of the things I found interesting was the judge actually said, look, be careful what you're saying or how you're interacting with the legal team. And I will be listening to your podcast. Yeah.

The Trial of Diddy

A Jury of His “Peers”

1319.19

I'm sure as the weeks go by, Mark will still be, you know, on that podcast discussing the case because that's what he does. But it'll be interesting to see how close and how more involved he will be in the next few weeks.

The Trial of Diddy

A Jury of His “Peers”

1338.738

There could be sanctions or anything like that if he's not careful, but we shall see.

The Trial of Diddy

A Jury of His “Peers”

1356.239

Yeah, she's a seasoned defense attorney. Again, she was in the Young Thug trial. We have heard that Diddy really wanted a Black attorney on the team. So it wasn't a Black woman, right? Yes. Now, it wasn't surprising to see her her name pop up. So, I mean, he has a good set of star attorneys.

The Trial of Diddy

A Jury of His “Peers”

1399.275

She's a very experienced prosecutor, handles the big cases, sexual assault cases, and having to do with human trafficking. So the fact that her name is in there and she's known as a very tough prosecutor and the rest of the team also very all decorated. And it is all women. And all women. Is that by design? What do we think? I don't know.

The Trial of Diddy

A Jury of His “Peers”

Welcome to the Trial of Diddy podcast. I'm Marjorie Hernandez. And I'm Germania Rodriguez-Poleo. We'll be back in a second.

The Trial of Diddy

A Jury of His “Peers”

1420.224

I don't know if that was just a look of the draw, but it does just in the optics. It does really, I guess, I think puts a very strong impression that these are female attorneys. And this is an important case that involves women victims mostly.

The Trial of Diddy

A Jury of His “Peers”

1458.09

He is very tough and he really likes to keep control of the timing and really is... warn both sides, look, we have to get it together. You guys put your motions together and we're going to get this trial going. So he's a no-nonsense type of judge.

And again, I think we mentioned it before that now viral video of Cassie essentially getting attacked by Diddy back in 2016 in a Los Angeles hotel. So it will be interesting to see Cassie there watching the video and being next to the man who allegedly killed

And something else that was interesting, Al B. Schur was actually on Fox 5 New York this morning promoting his book, Do You Believe Me Now? Which came up in jury selection.

So it was really, I don't know if it was timing, divine intervention, but LB did speak about his book. And in so many words, he said he believes that Diddy allegedly had something to do with his own illness. So let's take a listen.

We talk about Diddy, obviously, such a major figure in the hip hop world and in entertainment, period. But jurors also saw a list of potential witnesses who could be testifying. And that list is also celebrity-packed. We heard Michael B. Jordan might be called, Mike Myers, Kid Cudi, all sorts of people in the entertainment industry.

The Trial of Diddy

A Jury of His “Peers”

So it was also interesting to see how jurors, potential jurors, reacted to that list and what the judge asked them. Can you go over a little bit about that, Renato?

I have to say, Hermania has been doing a great job and also blogging as we're taking Dan Bates's notes, who, again, has been in court. Hermania has been updating our live feed. And there have been a lot of interesting things that came out during this jury selection process. Anything in particular that really interested you, Hermania?

Definitely. Again, he's a showman and performed in wide audiences before. And I mean, this is going to be the biggest audience he will ever have. So he's fighting for his life in there.

Renato, one of the bombshells that came out, I guess, today in the discussion between both sides is the fact that the prosecution is unsure whether or not victim three will actually be testifying. And secondly, we now know also Cassie Ventura, who is victim one. will be taking up most of next week when she testifies.

We're just wondering if you can comment a little bit about victim three, the fact that she's MIA. And secondly, Cassie right now is very pregnant. And I was wondering if you can talk a little bit about just the optics of having Cassie Ventura

That's right, Kayla. One of the many sexual assault lawsuits filed against Diddy was dismissed on Monday, March 31st. Jane Doe had claimed Diddy attempted to sexually assault her while at a party in New York in 1995. She also alleged that Diddy hit her when she refused his advances. Her attorney, Tony Busby, filed her suit back in October 2024.

Nadia, you mentioned testing, doing background research on potential jurors, but actual mock trial, does that happen as well? And in a big case like that, is that something you think Diggie's team is looking into?

I found it interesting because TMZ actually did their own mock jury. It was very interesting because they actually had an issue with the racketeering charge because they were thinking about how did he have profited from this crime?

And I was just wondering if you are in Diddy's team or really the prosecution's team also, would that be something that you could somehow prepare for when picking a juror?

Diddy's legal team asserted to the Daily Mail that this dismissal is what they see as a sign of what's to come with other pending cases. Their statement reads, quote, Today, a federal judge dismissed a lawsuit filed against Mr. Combs by Texas attorney Tony Busby and his local counsel Antigone Curris on behalf of an anonymized plaintiff.

Now, would the questionnaire or even maybe during Vaadir, would this come up in terms of the other cases involving Diddy? Obviously, he's facing this criminal case, but there have been dozens and dozens of civil lawsuits filed against him. It's out there almost every day. There's a new one filed. And I was wondering how that plays into picking a jury.

This is now the second case brought by these attorneys against Mr. Combs that has been dismissed in its entirety. It will not be the last. For months, we have seen case after case filed by individuals hiding behind anonymity, pushed forward by attorneys more focused on media headlines than legal merit. The other claims, like one dismissed today, also will not hold up in a court of law.
