And not only does this exonerate Diddy in this case and Jay-Z, but remember this was the case where there was that third female mystery celebrity. Celebrity B. Yeah, Celebrity B who allegedly watched and watched was involved, now this alleged celebrity who was there is also off the hook if they ever existed in the first place.
Yeah, the lawsuit mentioned it was a female celebrity, but was never named.
Never named, and we were never going to speculate. Our lawyers would never let us get away with that.
Okay, and with that, let's welcome this week's guest, legal analyst and trial attorney, Kelly Hyman. Hello, Kelly.
Hi, thank you so much for having me on your show. Thank you for being with us. You're from in sunny Florida. I'm so jealous. Marjorie was working on a story, I think, today about the latest filings.
Well, Diddy's lawyers actually asked the judge dismiss count three of his superseding indictment. And what was interesting is his argument or his attorney's argument that this no white person has ever been targeted of this similar charge. And they're claiming that because he's a powerful black man, that he's being targeted for that charge. And I was wondering what your thoughts were on that.
You know, is this just another way the attorneys are trying to get him off?
Well, no one is above the law, but the state who brings the case has the burden of proof, the government. And so they must prove every single element of the cause of action. And then when someone brings a motion to dismiss, basically saying that you're asking the court to dismiss a case, to dismiss account of a case, and then you make legal argument.
But ultimately, the judge is going to look at the law because that's the key thing. Look at the law and based on the law and facts presented, whether this third cause of action should be ultimately dismissed.
