And welcome to a special bonus episode of The Trial of Diddy on the day Sean Combs' attorneys asked Judge Aaron Cerbermanian to delay his May 5th trial by two months so they can better prepare for their defense.
Chapter 3: What evidence is the defense claiming they need?
As we mentioned on the main episode this week, a few days ago, the defense lawyers wrote to the judge claiming the prosecutors have been slow to turn over some potential evidence for review, including materials relating to a superseding indictment returned by a grand jury earlier this month. These actions have, they say, made it difficult for them to fully be ready in three weeks.
Chapter 4: When is the trial date set for Diddy?
Now, Diddy's lawyers say some evidence have yet to be released to them includes materials related to a count in the indictment that carries a 15 year mandatory minimum prison sentence if a conviction is cured. In reaction, they wrote, quote, We cannot in good conscience go to trial on the scheduled date. This is a problem that the government has created, yet it opposes our reasonable requests.
As we know, prosecutors opposed the request and the judge said he would address the issue during a hearing that was scheduled for today, Friday. And now he has and the request has been denied with a judge saying jury selection for the trial will begin on May 5th as scheduled. Adding, quote, it is unclear why there isn't sufficient time to prepare.
Chapter 5: What is the status of Diddy's bail?
Diddy has of today been held without bail for 213 days since his arrest last September. And he has vehemently denied every allegation made in all recent lawsuits filed against him. And he also has denied all federal charges that have been filed against him. But that wasn't all that happened today.
Diddy's attorneys also asked the judge to order former girlfriend Cassie Ventura to turn over the draft of her memoir and notes. Although she's actually not named in that motion, Diddy's attorney, Mark Agnafillo, has claimed Cassie wrote a book about him that he could, quote, catch and kill for $30 million, which is according to TMZ.
Cassie's attorneys filed a motion to block this and claimed that he even wanted her bank statements. The judge ruled that Cassie must turn over her memoir drafts by April 25th, but not her financial statements. Diddy's attorneys also filed a motion to block the now viral CNN video of Diddy attacking Cassie at an LA hotel back in 2016.
They claimed the video was edited to make Diddy look more menacing compared to the original hotel surveillance footage. They also claimed CNN destroyed that footage. CNN denying the allegations asserts that it neither altered the footage nor discarded the original, which it says remains with the source.
On Friday, the judge also denied an attempt by Warner Brothers Discovery to hold back outtakes from its Fall of Diddy docuseries from January of this year. Specifically, the footage the defense want to see involves a former employee of Combs' and an ex-girlfriend.
Warner Brothers Discovery attempted to use reporters' privilege to keep the outtakes out of the case, but the judge rejected that notion because both of the individuals in the footage seem likely to be giving testimony in the trial, and therefore the outtakes are deemed relevant and admissible. As we're recording this episode, they're actually still in court, but we do have a reporter inside.
