The difference was in the second trial, both brothers were limited in what evidence they could introduce about abuse. And again, this is key. Every court that has looked at this has said there was no mistake there. It was right to not allow them to introduce all that evidence because a Lyle didn't testify in the second trial because he made a big mistake.

Between his first trial and his second trial, he ended up confessing to somebody that he kind of snowed the first jury and said things that if he took the stand in his second trial, he would be cross-examined about and he'd be really in trouble. And also the judge said for the second trial, they can't introduce as much evidence about abuse because it's cumulative, it's repetitive.

I'd have to be clear about this. There's a misunderstanding. There's this concept that all the brothers were railroaded in their second trial. They weren't able to introduce any evidence of abuse. That is not true. In the second trial, Eric was able to testify for seven days.

He was able to call witnesses like a doctor who testified that he suffered from PTSD and that this could be caused by abuse. Family members talked about physical abuse, verbal abuse. Their cousin testified that Eric had told him Jose had molested him. There was another doctor who testified about Eric having anxiety disorder.

Lyle ended up relying on a lot of those witnesses because he didn't take the stand and because he couldn't take the stand. He didn't lay a foundation for all that evidence to come in. So he was mostly relying on his brother's witnesses. But at the end of the day, the jury in the second trial didn't believe it.

They didn't hear as much as the first jury heard. So in the second trial, there were 64 witnesses called, I believe. In the first trial, there was 101. But there was evidence of sexual abuse, verbal abuse, physical abuse that that second jury did hear. And even though they were Eric's witnesses, they could have. attributed that to Lyle, too.

And at the end of the day, they found both brothers guilty of murder. And I think the important distinction is I personally believe there's strong evidence based on the brother's testimony, based on these witnesses, that these brothers were abused in one way or another. But what that means is just because they're abused doesn't mean that they should be found not guilty of first degree murder.

That's a tricky question. There are those who would say she participated in the abuse. There are those who would say not necessarily the sexual abuse, but other kinds of abuse. And then there are those who would say she was just turned a blind eye. There were others who say she knew what was going on and didn't stop it.

You know, one of the allegations that came up in the second trial is you had witnesses who said that when Jose would take his boys into a room, into the bedroom, no one was allowed in. California has a very specific law, resentencing law, where someone can actually be resentenced if they show good behavior, if in the interest of justice they should be resentenced. This is not about whether there's new evidence in their case, whether or not they're innocent or not.

It's just you look at somebody and you say it's not right that they're going to be spending the rest of their life in prison. And I think he indicated that 300 people in California have been resentenced under this law, 28 for murder. But there's two arguments going on. One, that he says they should be resentenced.

If you look at their habeas filing, this motion, you say, oh, based on this new evidence, I didn't think they got a fair trial. I think the conviction should be overturned. Yes, it seemed to me what he really objected to was the characterization, A, of his brother Lyle, this kind of caricature person that they made. But the bigger issue was there were implications in that show that the brothers were... intimate with each other. I mean, for lack of a better phrase. And I think that was really objectionable. And I don't think that they appreciated the way that they were portrayed and particularly his brother was portrayed. But I think that that show and the outpouring and support from that show had a big effect on what's happening right now.

I don't think they should be eligible yet. They've served 35 years. They need to serve a full 50 before they're eligible another 15 years or completely deny it. Nope. I don't believe it. Life in prison. That's where they belong. And that's it. And then they'll fight it on that other issue, the habeas issue. It's a little bit tough to say.

And they went on a $700,000 shopping spree after killing their parents. They bought Rolex's clothing. They put an investment in a restaurant. And look, you know that the problem for them is later on, as I'm sure we'll talk about, they said that they had no choice but to kill their parents. They were under duress. They were abused.

It was actually worse in real life, because whereas you watch on the TV show, the parents seem to know the brothers come in. Basically, what it means is, I might have an unreasonable belief, an unreasonable belief my life is in danger, but as long as I really legitimately felt it, you can argue imperfect self-defense. And the idea of going out, buying the guns, going out to the car, reloading, that's what made this look a lot more premeditated and really was problematic for the brothers as if they just felt they had no choice but to take whatever weapon they had at that moment, defend their lives. He was a record executive of RCA. He signed a number of big bands. He was an immigrant, came to this country. He's a success story about how he built himself up. And I think that part of it is portrayed very well in a lot of the documentaries. And as you hear more of these stories, it wasn't the anger just directed at their father was also directed against their mother. And The problem, again, legally speaking, and I think what really was a problem for the brothers is, you know, at one point in their second trial that they were able to argue heat of passion. They were in the moment they killed their father.

What they couldn't argue is heat of passion with respect to their mother. You will hear a lot of legal analysts say there was a kiddie problem. In these killings, they might have been justified, maybe under the law to kill their father, but they weren't quite justified to kill their mother.

And that is something I think we should always just keep in mind that they were convicted of double murder, not just to their father, but their mother. And despite deficits in her being a mother and there's been abuse allegations as well, there is a difference there. And I want to be clear about that.

So when they showed up, the brothers are hysterical. And initially their first thought. tale, if you will, was that this could have been gang related, that Jose was involved with some shady characters. And you know what? That's not a far stretch.

When you look at that crime scene and you look at how they were gunned down with shotguns, you wonder, was this an assassination because of Jose's businesses? It's not outside the realm of possibility. And you have these two brothers who plan this very well. And we're very consistent in how they felt about things. And also, look, you're dealing with something from the late 80s, early 90s. We don't have the same kind of technology that we have today. And trying to see clues in a crime scene like that is very different than it is today. A wealthy neighborhood like that, seeing these two people gunned down in that manner, it didn't make sense that the brothers would do that.

But if you look a little bit closer, you could see that some parts of their narratives weren't making total sense. And I think that when you go back and you see it, you just realize that in the end of the day, what really did make sense is you had two sons who killed their parents in cold blood. And that's where the evidence lined up.

So what happened was, you know, as time goes on, and I want to be clear to your listeners. They could have gotten away with this forever. No one would have known. But Eric, it seemed to be he really had a guilty conscience. When the brothers were first arrested for robbery or stealing from houses, they had to see a psychiatrist.

And Eric ends up confessing to this psychiatrist he and his brother's role in the killings of their parents. Lyle ends up showing up to that office and threatens the psychiatrist. From there, the psychiatrist's mistress ends up being the key witness who turns on him, ends up exposing everything that happened.

And if it wasn't for Eric admitting what happened and Lyle showing up, there's a strong chance that these brothers may never have been caught. It was just it seemed to be. And this is why Lyle, I think there was a part of it where he blamed Eric for what happened.

So there was two trials. And the first trial ended up they were tried separately, the brothers, and there were two hung juries, meaning both juries for each brother couldn't decide whether or not this was murder or manslaughter. And that's key because of the first trial. Manslaughter was an option. They were able to argue imperfect self-defense, which I mentioned before.

And what happened was the majority of the jurors. I think the male jurors wanted first-degree murder. The female jurors wanted manslaughter. And the brothers were able to fully put on – and they both testified that they were abused by their parents. And they felt that they were in fear for their lives, that if they were to expose their parents, their parents were going to kill them.

And that's what kind of – gave pause to the jurors. What ended up happening was, and this is incredibly significant, going into the second trial, the prosecutors realized we need to change our tactics. And they objected to the defense being able to argue imperfect self-defense. And the judge agreed. And by the way, that has been upheld by every court that has seen this issue since that.

They might have had a general fear of their lives, but they didn't have a specific enough fear to justify gunning down their parents. In the second trial, manslaughter wasn't even an option with respect to Kitty. It was an option with respect to Jose.

At 7.04 a.m., he hails a cab, slipping into the backseat. His escape is in motion. By 7.30 a.m., he's seen near the George Washington Bridge, close to the Port Authority bus station on 178th Street.
