Chapter 1: What are the latest updates on Diddy's trial?
BBC Sounds. Music, radio, podcasts. Hello and welcome back to Diddy on Trial from BBC Sounds with me, Anushka Matandadauti. How many times has our resident criminal defense attorney, Sean Kent, told us that the prosecution and the defense are playing a game of adjournment chicken? Sean has been telling us that he thought both sides aren't fully prepared and that they were waiting to see who would blink first. Well, it was the defence. They blinked and they blinked big.
Just a few weeks before opening statements, they asked the judge, Judge Arun Subramaniam, for a two-month delay. And he said, not today. If you're not ready now, get ready. Pratiksha Gildayal is a senior producer for the BBC in New York and she was in court with Didi last week. Hi, Pratiksha. Hi, Anushka. How are you? I'm good, thank you.
Chapter 2: Why did Diddy's defense team request a delay?
I'm interested to see what were the main requests that were being made in that courtroom. What did it kick off with?
Right. So Anushka, we saw Didi in court not once, but twice last week on Monday and on Friday. On Monday, if you remember, he was arraigned on additional superseding charges, which means he was produced in court. He pleaded not guilty to additional charges which have been brought by federal prosecutors, which include charges. trafficking, as well as engaging in prostitution.
Now, these are more recent charges from recent years and involve a new alleged victim, apparently. On Monday is the first time we had heard that they may ask for a delay for an adjournment. And on a couple of days after that, they did file a letter asking for a two-month delay. So when they asked the judge, was it the first thing that they said in court? We want two month delay.
Chapter 3: What happened during Diddy's recent court appearances?
How did that come about? It was basically the judge saying, you know, what are the issues that we need to look at? What are the issues we need to iron out? And that's when the defense said that, you know, we need more time. But then the judge said that, you know, it was a very broad request and they do need to make it more specific and narrow it down.
When he denied the adjournment motion on Friday, he did say that it was too close to the trial. When the judge denied the request for the adjournment, what was the response from Diddy's side of the room? Once the judge has said the motion is denied, they just had to accept that. But then the judge was very clear. He was like, this is not a time for a fishing expedition. And he
Didi does have four attorneys. So between them, they should be able to work it out and be prepared in time for jury selection that starts on May 5th and opening statements which start on May the 12th. How was Diddy in the room? So Diddy appeared wearing, like, sort of light tan prison attire. And he was wearing slip-on shoes. He looked fairly relaxed, if a bit solemn.
He's grayed substantially the past few months, like silver hair. His beard appeared pretty trimmed. Like, he, you know, maintained it well. He seems to have lost weight.
and on friday his mother and one of his sons were there at the hearing you know we were seated behind him and all the lawyers and there were times when he turned back and he was probably either looking at his mother or his supporters and there were times he was nodding to what the judge was saying one thing that struck me was also that when he entered the the courtroom he hugged each and every one of his lawyers before he sat down
And he engaged with them. He was talking to them, nodding along.
I think that it's interesting because from the beginning, he's pushed for this speedy trial. What was his exact reaction to the two month delay being denied?
From what I could see sitting there. Some rose behind him. He just seemed to listen to the judge denying the motion calmly. And I think it would have been a big support for him to see his mother, to see his son. There was also there were other supporters. There was one supporter wearing a free puff sweatshirt there. He turned around at one point.
He seemed to say, I love you to his mother, is my understanding.

Sean, this latest civil case that's been filed by Busby, Shannon Sharp has responded on Instagram with a statement from his lawyer. It's a long one where he names the Jane Doe and then lists multiple texts that he alleges that she sent to him. Is that legal?
Technically, a lawsuit is just a filing of a lawsuit. It's a complaint. It's one party saying something that has happened. The other party gets a chance to respond, which is called an answer. That answer is filed out and filled in court. Now, in his answer to the court, he cannot respond to her name. But to John Q. Public, he can do whatever he wants until a court specifically tells him no.
And no court has ordered him not to. So it would be the equivalent of if I knew her name or her cousin knew her name or anybody who knew her name and went on C-SPAN and just said, I want to talk about her. So there's nothing to stop it. Most people don't do it, but there's no court order stopping it right now. It's rare and it's wild. And I thought it was interesting.
Can it annoy the judge, like put you in bad standing with the judge?

We met Brian Steele. We've known each other probably going on about a decade. We met each other in a federal case that we had down here in South Carolina. He was brought along to help a co-defendant. So we spent about a month together in steamy Columbia, South Carolina.
I am wearing a couple of organizations, some high-profile organizations throughout the country together, American Board of Criminal Lawyers to be one. I consider Brian the best of the best. He is a quality trial lawyer. He's a quality lawyer. He is a great person. The best way to describe it, he's known for being incredibly polished. He is well thought out. He is meticulous.
He's just a hard worker. And he is a lawyer's lawyer. He is a really, really good lawyer. And I don't like to give anyone compliments that's not named Sean Kent. So for me to give him a compliment, I'm at good of a lawyer.
What do you think his first thing would have been when he came on board? What would he say first?
Can we get this case continued? But if I know Brian the way that I know him and the amount, and let's not forget, this is a terabyte of information, which basically means you can stretch each paper around the world. That's how much information there is. Knowing Brian, he said, I'd love to be a part of the team. One, what do y'all envision me doing?
And two, most importantly, do I have enough time to get what I need to get done? So I bet you they told him that we will be asking for a continuance. My assumption is that they said, we believe we will be getting the continuance. And then it didn't happen. And so everybody's regrouping now.

Chapter 6: What is the significance of the 404B evidence in Diddy's case?
Yeah.
You're not wrong. But, you know, for me, looking at the other side, the way that I would say it is Diddy's on trial for his life, whether we like him or don't like him, but he is fighting for his life and I'm fighting for his life. He wants every avenue possible. These accusations are coming. But from a journalist standpoint, I'd be like, wait a minute.
These outtakes, that damages the process that we can't get people to be genuine because they're worried about what's going to happen in a cross-examination. And as a journalist, I think I'm sure you understand getting somebody comfortable off camera is one of the hardest things to do. And we have to do certain things to get them off camera.
And we shouldn't have that used against someone on the stand. It goes both ways.
I'm assuming, though, that there's already pretty strong precedent for the ruling that the judge made on that. 100%.
And I've done it myself and I've used it. And so if I ever choose to see you guys, can I have your outtakes, please?
I don't have but a buck oh five, Sean. Maybe you can have it. And then the last ruling, I think lots of people on social media were anticipating this. We know victim one is going to appear under their own name. Victim two, victim three, victim four can appear with pseudonyms. It doesn't say victim five here. It doesn't say victim five, right?
What's going on with victim five? Victim five to me is the most interesting. We just randomly throw in victim five. Let's not mention her again, her or him or whoever it is.
But surely the logistical considerations now for victim two, three and four are going to be massive because there's going to be press outside of the trial. It's a public court. So the public can go, the press can go, family, friends, whatever. How do they appear in court then if they're under pseudonyms?
