That comes in under one potential hearsay exception, as well as potentially two. One is an excited utterance, but it easily comes in as an admission, as it is the defendant's own word. And there's kind of this dispute, which says like, I hit him, I hit him, or did I hit him and stuff like that. So it still kind of says the same thing. One is I'm admitting to it.

The other is I'm aware that I hit something on the night in question. I didn't know exactly what I did was, oh, my God, did I actually hit John? I just thought I hit maybe like a mailbox or something. That's definitely how it kind of played into it. It wasn't like this.

When it's not on video and it's not recorded in like a police report or an incident report, it's definitely always causes one to pause. But given the sheer number of people who actually heard it, and it was kind of different variation. Remember, it was two and a half years ago.

So I definitely think that at worst, the admission was I knew it was a possibility I hit something or I guess I hit John and I didn't mean to.

In his clothing, they found microscopic pieces of her taillight that are so small you couldn't even pick up.

The defense was arguing that this was a conspiracy, Michael Proctor and all this, that it was an unsecured crime scene, this, that, and the other. Okay, all well and good. But unfortunately, when you have those pieces of the taillight in the clothing that are so small, that how would somebody actually plant this if you can't even pick it up?

And the only rational conclusion is Officer O'Keefe was struck by this vehicle because they matched the taillight that was cracked, and those same taillight pieces were found on his clothing.

So the defense was trying to argue that when she backed up into Officer O'Keefe's vehicle, that's when her taillight cracked.

Unfortunately for her, there were two real issues with that. One, none of the pieces of the taillight were found near Officer O'Keefe's vehicle that she backed up into. Could they have been picked up and moved? Yes. OK. But when they're actually found, they're actually found at the scene. And the other pieces of the taillight were found on his clothing.

So when you put it all together, it's like, okay, all right, maybe they could have picked up the big pieces and moved them over to the crime scene, all right, to plant them. All right, that's possible. But how does the other pieces get on his clothing that you can't pick up?
