There was no collision with John O'Keefe. There was no collision. There was no collision. John O'Keefe did not die from being hit by a vehicle, period.

This case carries a malignancy, one that has spread through the investigation. It spread through the prosecution from the very start, from the jump. A cancer that cannot be cut out, a cancer that cannot be cured. And that cancer has a name. His name is Michael Proctor.

Picture the scene. Blood-curdling screams. ambulances, emergency lights on, fire engines, ladder trucks, paramedics, patrol vehicles, patrol cruisers, police officers, first responders, firefighters, all swarming all over Brian Albert's lawn, literally feet under his bedroom window. Yet Brian Albert, a sworn peace officer, a first responder himself,

KAREN: THE RETRIAL

Trooper Paul didn't seem to understand what he was applying. He noted that he had 120 hours of study. And when he was asked questions, he just really struggled. His explanations were things like, well, that's just how it happened. He was forced to amend his sort of version of how things happened to move John O'Keefe, his sort of initial starting point, another 10 feet.
KAREN: THE RETRIAL

And the problem is that this gets us to what ends up being a very implausible vision of how this vehicle collision happens, because, of course, they're not alleging that it's an accident.
KAREN: THE RETRIAL
Impasse: S1-E8
Their theory is that the vehicle hits sort of just his arm, breaks the plastic, the polycarbonate there, and then somehow from that throws him quite a substantial distance to hit his head and ultimately come to a rest some 30 feet away. When you just picture that in your head, it looks ridiculous. It looks on its face to be sort of cartoonish.
KAREN: THE RETRIAL

So I found that to be striking because he is critical to the prosecution's case. This is their whole theory of what happened. And he's the linchpin of it.
KAREN: THE RETRIAL
Impasse: S1-E8
And he's a critical witness because they're trying to explain that this is a motor vehicle impact with a pedestrian, and they're trying to provide a coherent explanation for how that happened.
